In accordance with the Federal Law for the Protection of Personal Data in Possession of Private Entities (hereafter the “Law”), the Bylaw for the Federal Law for the Protection of Personal Data in Possession of Private Entities (hereafter the “Bylaw”), and the Guidelines for Privacy Notices (hereafter the “Guidelines”, which in addition to the Law and the Bylaw constitute the “Applicable Legislation”), we hereby present to You (hereafter both “You” and/or the “Account Holder”) this Comprehensive Privacy Notice (hereafter the “Privacy Notice”).

This Privacy Notice is available so that You can read it carefully. Throughout this Privacy Notice, SiiLA RE SOLUTIONS MX S.A.P.I. de C.V. (hereafter “We” or “Us”) will refer to the treatment We will give to any personal data You provide to Us. Providing any personal data to Us constitutes your acceptance of this Privacy Notice.

  1. ON OUR IDENTITY AND ADDRESS. We, SiiLA RE SOLUTIONS MX S.A.P.I. de C.V. located at Varsovia 36 - 204, Juárez, Cuauhtémoc, Postal Code 06600, Mexico City, will be responsible for the treatment of any personal data You provide to Us in conformity with this Privacy Notice.
  2. ON THE PERSONAL DATA WE WILL COLLECT. The data You will provide to us for treatment under Section 3 of this Privacy Notice are: (i) Given name(s) and Last names of the user; (ii) Address; (iii) Landline and/or Cellular phone; (iv) Electronic mail address; (v) Financial information; (hereafter, the “Data”).
    We will in no way request, and You will never provide, any sensitive personal information; that is, any intimate personal data or any information that might potentially be used for discriminatory purposes or originate any grave risks for You. Specifically, You are bound never to provide any information regarding your racial or ethnic background, health, genetics, religious, moral and/or philosophical beliefs, union membership, political preferences, and/or sexual orientation.
  3. ON OUR TREATMENT OF YOUR DATA. All data You provide to Us is necessary for Us to: (i) Give users access to our platform and/or services; (ii) Collect the monthly payment for the use of our platform and/or services through any payment systems You and Us have agreed to; (iii) Send information related to our platform and/or services; and (iv) Share information for marketing, publicity, and commercial forecasting purposes.
    The treatment your personal Data will receive according to numerals (i), (ii), and (iii) above is necessary for the existence, prevalence, and fulfillment of the relationship between You and Us. Therefore, whenever we lack access to the relevant information, We will not be to enable You to access our platform or offer You our services. In order to request that We stop using your Data for the purposes referred to in numeral (iv) above, You must send Us a written communication that adheres to the specifications set forth in Section 6 of this Privacy Notice.
    By providing your Data, You tacitly accept that We will treat your Data according to the ends We have set out above, for as long as necessary for the existence, prevalence, and fulfillment of the relationship between You and Us.
  4. ON THE WAYS WE WILL TRANSFER YOUR DATA. In order to fulfill the purpose of this Privacy Notice, We may transfer your Data to any natural and/or legal persons We work with so as to provide You with access to our platform and enable You to make use of our services. Said legal persons may be: software developers; real estate service providers and advisors; financial appraisers; infrastructure and real estate trust funds (“Fibras”); retirement fund managers; and financial market participants. We may also share your Data with legal persons that belong to our same business group. These transfers may be realized nationally and internationally.
    Any transfers realized under the terms of this Section will be necessary to fulfill the legal relationship You and Us hold, in accordance with the legal relationship that exists whenever You gain access to our platform, as well as with the use You make of our services.
    Once You provide Us with your Data, these will be held in various secure platforms according to the technology we have available, and only natural or legal persons we share your information with will have access to your Data. We consider we have adequate security measures to protect your Data from use by unauthorized third parties. If any authorities should claim access to your Data, we may share your Data only in accordance with any applicable legal instruments.
  5. ON THE WAYS YOU MAY EXERCISE YOUR ARCO RIGHTS. You will always have access to your Data and will hold the right to modification, cancellation, or opposition (hereafter “ARCO rights”).
    To exercise your ARCO rights, you must send a written request to Us by post mail or electronic mail. It must be addressed to Alejandro Delgado Ramos. If you choose to send your request via post mail, you must use the following address: Varsovia 36 - 204, Juárez, Cuauhtémoc, Postal Code 06600, Mexico City.     Your request to exercise your ARCO rights must include the following: (i) The full name of the Account Holder, their address and/or electronic mail address, and/or any other information that may allow Us to communicate our response to their request; (ii) Any official documents that prove your identity as the Account Holder or, if applicable, your legal power to represent the Account Holder; (iii) A precise and clear description of the Data around which You wish to exert your ARCO rights; and (iv) Any other element or documentation that might aid Us in localizing the Data.
    Once We receive a written request to exert your ARCO rights, We will have up to 8 work days to analyze and tend to your request, as well as to provide You with the corresponding response. We will make our conclusions known to you via electronic or post mail according to your expressed preferences.
  6. ON COMMUNICATION MECHANISMS. For any other communications you may want to address to Us regarding this Privacy Notice or any limits to our use or sharing of your Data aside from the procedures We have set forth in this Notice, You may send a written document to the same addresses set forth in Section 5, including clearly and precisely: (i) The name of the Account Holder, their address, and/or their electronic mail address; (ii) Any official documents that prove your identity as the Account Holder or, if applicable, your legal power to represent the Account Holder; and (iii) The purpose of your communication.
  7. ON OTHER RESOURCES TO LIMIT THE USE OR SHARING OF YOUR DATA. The Account Holder may present themselves at the Public Register of Consumers or call via telephone to request their subscription, and/or present themselves at the Public Registry to Avoid Publicity or call via telephone to request their subscription, according to any guidelines set forth by the Consumer Protection Federal Agency (Profeco) in the applicable law. The Account Holder may also contact the Public Registry of Users set forth by the Law for the Protection and Defense of Financial Services Users, so as to limit the use of their personal data by private entities.
  8. ON REMOTE MEDIA. If for any reason You provide Us with your Data via any electronic media, including our website www.silla.com .mx, You understand and accept that: (i) Our website may include links to third party websites which, in case You access them, will lead You to leave our website, and We bear no liability regarding any third party websites; (ii) Our website may include links to websites that manage social media, and therefore You accept that whenever You provide any information, including your Data, through those websites, You will allow said information to be read, seen, accessed, transmitted, and processed by any person, releasing us from any liability; and (iii) It is possible that our systems, including our online platform, may collect additional Data to the information you provide Us with, including your type of navigator, your operating system, your visited websites, your IP address, etcetera, via “cookies” or “web beacons”, among others. To disable said systems, you may access “Internet options” under the “Tools” menu in the navigator you use.
  9. ON MODIFICATIONS TO OUR PRIVACY NOTICE. We may modify this Privacy Notice to ensure consistency with all applicable legal ordainments, to comply with any requests by the authorities, and/or as We deem convenient. As long as We do not modify our identity, require any more Data than those already set forth above, modify the purpose of this Privacy Notice, and/or change the transfer conditions, You understand and accept that our way of notifying You of any changes in this Privacy Notice will be the posting of any revised versions on the following website: siila.com.mx. For cases in which your consent is needed to tend to the changes made to this Privacy Notice, We will deliver the corresponding notification to any of the outlets You have listed as your contact information. You will be understood to accept any modifications to our Privacy Notice as long as we do not receive any communications from You that declare the opposite. It is your obligation to periodically visit the aforementioned website to verify the current version of our Privacy Notice.
